Wistly Terms of Use

These Terms govern your use of the Wistly app and getwistly.com ("Wistly"), operated by Satoshi Yamane, an individual based in Japan. By using Wistly, you agree to these Terms. If you do not agree, do not use Wistly.
Eligibility
You must be at least 16 years old (or the age of digital consent where you live) to use Wistly.
Your account
You sign in with Google. You are responsible for activity under your account and for keeping your sign-in secure.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Wistly for your own personal, non-commercial use, subject to these Terms and the App Store rules.
Your content
You keep ownership of the notes, ratings, and other content you create in Wistly ("Your Content"). You grant us a limited license to host, store, process, and display Your Content solely to operate and provide Wistly to you — including generating your taste portrait and recommendations. You are responsible for Your Content and confirm you have the right to provide it.
Acceptable use
You agree not to: misuse, disrupt, or attempt to gain unauthorized access to Wistly or its systems; scrape or harvest data; reverse engineer except as permitted by law; or use Wistly unlawfully or to infringe others' rights.
Recommendations and third-party metadata
Wistly's portrait, scores, and recommendations are provided for your interest and enjoyment, "as is," with no guarantee of accuracy or suitability. Information about films, music, and books is provided by third parties (such as TMDB, MusicBrainz/Last.fm, Open Library, and Odesli) and remains the property of its owners; related names and trademarks belong to their respective holders. Wistly is not endorsed by or affiliated with them.
Disclaimers and limitation of liability
Wistly is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Satoshi Yamane will not be liable for indirect, incidental, special, or consequential damages, and our total liability will not exceed the greater of the amounts you paid us in the prior 12 months or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Termination
You may stop using Wistly and delete your account at any time. We may suspend or end your access if you breach these Terms or as needed to protect the service.
Changes to these Terms
We may update these Terms. We will post the revised version with a new date and, for material changes, notify you in the app. Continued use after changes means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Japan, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
Apple App Store
This license is concluded between you and Satoshi Yamane only, and not with Apple. Apple is not responsible for Wistly or its content. To the extent permitted by law, Apple has no warranty obligation with respect to Wistly, and any claims relating to it (including product liability, legal or regulatory non-compliance, or consumer-protection claims) are our responsibility, not Apple's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government prohibited-parties list.
